and other Federal AgenciesIn recent years, there has been an upsurge of
police activities in the USA, the nature of which most Americans would
more readily associate with repressive dictatorships. As early as the 1950s,
the FDA was engaged in aggressively spying on health-care providers who
employed medications and approaches which were not considered "acceptable"
by mainstream orthodox medicine. Notably, it was and has been the American
Medical Association (AMA) which has dominated ideas within the medical
community, as well as nearly all legislation related to health care.
If the AMA dislikes a particular health care approach, they work to
banish such methods within hospitals, and to suspend the medical licenses
of any 
doctor
who employs them. They have often been able to rely upon state licensing
boards and legislatures, and even the US Congress, to pass laws outlawing
natural healing methods and the non-MD practitioner (such as midwives,
herbalists or acupuncturists). Failing here, the AMA and friends in the
drug industry have relied upon their allies in the FDA to aggressively
assault the advocates of natural treatment methods. What
You Should Know About the FDA
Many new health care discoveries have thereby remained "underground",
never being allowed to flower productively in the light of day. Inexpensive,
non-toxic and unpatentable natural healing methods have never been seriously
or honestly evaluated by the AMA-FDA pharmaceutical-dominated medical establishment.
Instead, policemen have been called in to simply arrest and jail the offending
practitioners, seize their files, mailing lists and other property, burn
their books, and otherwise trample the US Constitution into the dirt.
Increasingly,
health care decisions in the USA are being mandated by small cadres of
"specialists" who decide whether this or that medication will be made legal
and available to the American public. Where scientific evidence once was
the criteria for extended use of a new medication, such decisions are today
being made more on the basis of the profits which can be made from a particular
medication -- too many of the top physician-bureaucrats working in the
FDA, National Institutes of Health (NIH), American Cancer Society (ACS),
etc. are themselves often drug-company millionaires, with personal stock
holdings or investments in the companies whom they regulate. Drug companies
provide large sums to political campaigns so as to definitively influence
legislation, and to various medical institutes, to "research" their products.
Their full-page color advertisements for new drugs in medical journals
essentially pay for those publications. Pharmaceutical companies are one
of the highest profit margin industries in the U.S. who do not have to
account for the often extreme prices they charge - higher than anywhere
else in the world. Drug company money plays a powerful role in shaping
health policy, the approval process for new patent drugs, and publishing
(or censoring) research findings about the effectiveness or side-effects
of those drugs.
According to a recent study in the New England Journal of Medicine,
about a third of all American adults use unconventional medical treatments,
such as chiropractic, therapeutic massage, relaxation techniques, special
diets and megavitamins. Americans are increasingly attracted to non-toxic
natural healing methods, as an alternative to the cut, burn and poison
methods of allopathic medicine. In recent years, there also has been increasing
evidence that vitamins and other items advocated by "health food nuts"
do indeed work to prevent degenerative diseases, and to promote recovery
and remission from severe illness. Health reformers are increasingly advocating
natural healing methods, including natural childbirth, home birth, breastfeeding
of infants, and organic fruits and vegetables Vitamins A, B, C and E in
moderate to high doses are increasingly being found to reduce one's risk
of heart disease, cancers, and other degenerative diseases. Indeed, the
National Institute of Health, in response to growing pressure from the
public, recently opened an "Office of Alternative Medicine", and has started
to fund investigations of natural healing methods.(10)
The percentage of Americans attracted to natural healing methods is
growing and threatens the economic monopoly of Big Medicine, the AMA-FDA-Pharmacy
cartel, which has for many years dictated health care approaches used in
the USA with an iron fist. This appears to be the major reason for the
intensification of the FDA's vicious and murderous war against the natural

The
FDA goes after pet store owners too!
1990; El Cajon, California: The FDA attempts to railroad Sissy Harrington-McGill,
57-year old owner of a pet food store, for violation of a proposed "Health
Claims Law" because her literature stated vitamins would help keep pets
healthy. Her store was raided and ransacked without a search warrant. When
her day in court arrived, Harrington-McGill requested a jury trial -- the
judge refused her request, dictating that he alone would judge the case.
She was tried and convicted of violation of the Health Claims Law, even
though it had not yet been passed by the US Congress at the time the FDA
raided her, or at the time of her trial or conviction. Ms. Harrington-McGill
repeatedly informed the federal judge of this fact, but he ignored her
complaint. For this first-time misdemeanor "violation" of a non-existing
law, she was sentenced to 179 days in prison, with a fine of $10,000. She
was led away in chains and served 114 days in prison before being released
after the U.S. Congress refused to pass the "Health Claims Law". Lawsuits

Hid Names of Melamine Contaminated Infant Formula Products from the Public
The FDA found melamine and cyanuric acid, a related chemical, in samples
of baby formula made by major U.S. manufacturers. Melamine can cause
kidney and bladder stones and, in worst cases, kidney failure and death.
If melamine and cyanuric acid combine, they can form round yellow crystals
that can also damage kidneys and destroy renal function. Melamine was found
in Good Start Supreme Infant Formula With Iron made by Nestle, and cyanuric
acid was detected in Enfamil Lipil With Iron infant formula powder made
by Mead Johnson. more.

be given to a child over the opposition of his parents. Parents are medicating
their children for fear of having them hauled away by Child Protective
Services. In the UK Parents of children diagnosed with attention deficit

Mental Health Bill if they refuse to drug their children, a psychiatrist

Fined $1Million For Advising Juices, Natural Supplements
This is an old and familiar theme of abuse of power and suppression
of choice by the pharma-based medical industry in America. In this case,
we have a man, Larry Rawdon, who has a pharmacist licence in Tennessee,
but runs a health food store. Rawdon discovered what I and so many, many
other people have discovered - drugs don't work, but Nature based "medicine"
does. He tells people who seek his advice that taking freshly made vegetable/fruit
juices, along with supplements and coffee enemas, for example, will often
bring beneficial results in terms of increased energy and recovery from
disease debilitation (in essence, the Gerson Therapy which has been successfully
applied for 80 years since formulated by Dr. Max Gerson in the 1920s).
A man by the name of David Ashley, who had fourth stage pancreatic cancer-the

" .... The American people have made it clear they do not want the federal
government to interfere with their access to dietary supplements, yet the
FDA and the FTC continue to engage in heavy-handed attempts to restrict
such access. The FDA continues to frustrate consumers’ efforts to learn
how they can improve their health even after Congress, responding to a
record number of constituents’ comments, passed the Dietary Supplement
and Health and Education Act of 1994 (DSHEA). FDA bureaucrats are so determined

FDA bureaucrats have even refused to abide by the DSHEA section allowing

article concerning this topic is evidence of intent to sell a drug.
Because of the FDA’s censorship of truthful health claims, millions
of Americans may suffer with diseases and other health care problems they
may have avoided by using dietary supplements. For example, the FDA prohibited
consumers from learning how folic acid reduces the risk of neural tube
defects for four years after the Centers for Disease Control and Prevention
recommended every woman of childbearing age take folic acid supplements
to reduce neural tube defects. This FDA action contributed to an estimated
10,000 cases of preventable neutral tube defects!
The FDA also continues to prohibit consumers from learning about the
scientific evidence that glucosamine and chondroitin sulfate are effective
in the treatment of osteoarthritis; that omega-3 fatty acids may reduce
the risk of sudden death heart attack; and that calcium may reduce the

Anti-Health Legislation being Passed in Australian Parliament
Without public knowledge or debate the Australian Government has initiated
steps to force the natural health industry under the control of multi-national
drug corporations. Autralians and New Zealanders will lose the right to
choose Natural health care if the Australian Government's secret legislation
is not stopped. Since Pan Pharmaceuticals was gutted by the TGA in
2003, the regulator has installed drug corporations on committees that
have generated volumes of new laws that have sent the Australian supplement
industry to the wall, making the markets ready to be taken over by drug
companies.
The war on supplements is nothing but a trade war. Supplements are hurting
drug companies. They want their share of the action. Drug companies have
lobbied the Australian government to bring about massive secret changes
to Australia's health care structure. Here's what they've done: The Australian
Government has signed an international treaty (known as the JTA Treaty)
in 2003 which forms the basis for a massive new international regulating
"agency". This is due to come into effect July 1, 2005. unless the voters
stop implementing legislation from being passed by Parliament.
This new regulating agency, called the Trans Tasman Agency is structurally
nothing more than an off shore corporation partnered by the TGA and multi
national drug corporations. That means multi-national drug companies will

In the U.S., Americans who write to Congress to demand an Oversight Hearing
on Codex are being told that a Federal Statute already protects their rights.
This is misleading.

Current pressure to set arbitrary "safety standards" for vitamins (UL's
or Upper Levels) in the US could set the stage for harmonization.

"If Codex Alimentarius has its way, then herbs, vitamins, minerals, homeopathic
remedies, amino acids and other natural remedies you have taken for granted
most of your life will be gone. The name of the game for Codex is to shift
all remedies into the prescription category so they can be controlled exclusively
by the medical monopoly and its bosses, the major pharmaceutical firms.
Predictably, this scenario has been denied by both the Canadian Health
Food Association and the Health Protection Branch of Canada (HPB).
The Codex proposals already exist as law in Norway and Germany where
the entire health food industry has literally been taken over by the drug
companies. In these countries, vitamin C above 200 mg is illegal as is
vitamin E above 45 IU, vitamin B1 over 2.4 mg and so on. Shering-Plough,
the Norway pharmaceutical giant, now controls an echinacea tincture, which
is being sold there as an over the counter drug at grossly inflated prices.
The same is true of ginkgo and many other herbs, and only one government
controlled pharmacy has the right to import supplements as medicines which
they can sell to health food stores, convenience stores or pharmacies."

The battle between the rights of consumers, natural health practitioners
and healthfood manufacturers versus the corporate health and pharmaceutical

Raid on
family's home and organic food co-op
December 17, 2008 - The Farm-to-Consumer Legal Defense Fund (FTCLDF)
today joined the Buckeye Institute’s 1851 Center for Constitutional Law
in filing a civil lawsuit against the Ohio Department of Agriculture and
the Lorrain County Health Department for an illegal raid on the residence
of the Stowers family in La Grange, Ohio. (Click here for the complaint).
The complaint claims that the Stowers’ due process, equal protection and
other constitutional rights were violated when their house was raided by
representatives from various state and local governmental agencies, including
the Ohio Department of Agriculture. The Stowers, who operate a private
cooperative known as Manna Storehouse, were the target of a raid of their
personal residence by sheriff deputies and Department of Agriculture personnel,
several of whom had guns drawn and who treated the Stowers family like
drug dealers. According to the report of the sheriff's department, one
of the deputies even snatched a cell phone out of the hand of a teenage
son who was attempting to call Mr. Stowers at the time. In addition, the
complaint alleges the governmental authorities confiscated all of the Stowers’
personal food intended to provide for and nourish them all through the

herbs, botanicals, minerals and vitamins as food. -If herbs, vitamins,
minerals and botanicals are drugs then in order to sell them you need to
do testing which costs on average between $140 million and $500 million.
-The only companies that can afford to do this type of testing are the
pharmaceuticals putting all other vitamin, herbal and botanical companies
out of business. -The result is that you will see both poor quality natural
remedies product created by pharmaceuticals to keep you sick and the price
of your average natural remedy will inflate by a ridiculous 1500% !!! -Unless
you act now, you will only be able to get vitamin C as a prescription from
your doctor and only in amounts that meet the daily minimum requirement
which in vitamin C's case is 60mg.
HERE'S THE PROPOSAL THAT'S THREATENING YOUR HEALTH...
On October 7, 1996 the Codex Committee on Nutrition and Foods for Special
Dietary Use (NFSDU) considered a new proposal presented by Canada to: begin
a negative 'no trade list' of herbs and botanicals. start the process of
declaring herbs and botanicals at useful potencies as drugs, that is as
not foods. Take the steps to start the end of the of the current practice
of selling herbs and botanicals as foods and giving information on therapeutic
indications through the use of independent reference centers that tell
all about therapeutic and preventative indications. -The Germans put a
proposal on the table that said the following about vitamins and minerals:
to end the international trade in high potency vitamins and minerals by
reclassifying them as drugs, that is no longer as foods.
HERE'S HOW THESE PROPOSALS WILL TERMINATE YOUR FREEDOM...
If herbs, vitamins, botanicals and minerals are reclassified as drugs,
then the standards for producing and making these products will be so ridiculously
high that the only people who can afford to make these products are the
drug companies. -The result will be monopolies in the natural remedy market
by pharmaceuticals which will inflate prices dramatically and lower the
quality substantially. -The Codex laws will become internationally binding
under the GATT treaty and the escape clause will be removed.
Companies like Hoechst, Bayer, BASF, Degussa, Fresnius, Rhone-Poulenc,
Sandoz, and Novo Nordisk who can only survive if these changes are made
have manipulated the Codex committee to further the interests of the German
pharmaceutical companies. -In October, 1996 they were successful in jumping
from step 3 to step 5 of the ratification process. -The Codex delegates
meet again in 1998 at which point they will finalize the ratification process
and jump from step 5 to the step 8 which is the final step unless YOU do
something about it!!!.

Journal of the
American Medical Association acknowledge that adverse reactions to
doctor prescribed drugs and medical mistakes are the third highest cause
of deaths in America today. Accounting Office report found that 51.5% of
patent drugs approved by the FDA between 1978 and 1986 had "serious post-approval
risks" not disclosed on originally-approved package inserts, including
"heart failure, myocardial infarction, anaphylaxis, respiratory depression,
convulsions, seizures, kidney and liver failure, severe blood disorders,
birth defects and blindness".

clear we wanted to stop the FDA from conducting gunpoint raids on
doctors’ offices and seizing millions of dollars worth of supplement products.
The FDA made it vividly clear that it intended to remove such products
from the market because they represented competition to synthetic drugs.
Congress got the message and passed DSHEA unanimously.
While DSHEA has been a tremendous success and we still have supplements
on our shelves, the problem is that FDA officials, thanks to backing from
their Big
Pharma patrons, have never liked DSHEA and have never fully complied with
the law. In fact, while we citizens still function on the belief that PUBLIC
SERVANTS
(and we capitalize those words on purpose) are servants of the people,
FDA officials don’t seem to understand that they work for us. Instead,
they have creatively
used the law to twist it to their own purposes. In fact, there is even
a book entitled, “FDA’s Creative Application of the Law” which discusses
how the FDA
re-interprets the law to bring about changes in public health policy! YUP,
YOU READ THAT RIGHT! The FDA functions as its own policy making body without
our permission and apparently without any reprimands from Congress! [Read]
This is not news to the health freedom movement. We know it is standard
operating procedure for this agency to run amuck. We said as much in an
article we
published several weeks ago on NewsWithViews.com entitled, “A Call To Action
to Protect Free Speech”, in which we talked about a new bill that was about
to
be introduced to rein in the FDA. And in this week’s column we would like
to expand on that topic.
At issue is the fact that employees of the FDA don’t think the agency has
to abide by the U.S. Constitution or the law in general, when it comes
to allowing
manufacturers to make health claims about dietary supplements. Worse yet,
these same public employees don’t think we should be allowed to have truthful,
scientific
information about what these products can do for our health even if some
other arm of government produced it. May we repeat, FDA EMPLOYEES ARE
PUBLIC SERVANTS. THEY WORK FOR THE CITIZENS OF THE UNITED STATES OF AMERICA.
This new bill to curb the outrageous behavior of FDA employees is HR 4282,
Health Freedom Protection Act. It was officially introduced in Congress
on
November 9th and now has ten co-sponsors with more on the way. The current
co-sponsors are, Ron Paul (TX), Peter DeFazio (OR), Dan Burton (IN), Walter
Jones (NC), Rob Bishop (UT), John J. Duncan (TN), Roscoe Bartlett (MD),
Jeff Miller (FL), Butch Otter (ID), and Tom Tancredo (CO).
If any of these co-sponsors happens to be your personal public servant
in the U.S. House, please send him a polite thank you note and tell him
why it is personally
important to you that he is supporting this bill. If your public servant
in the U.S. House is not listed, then you have your work cut out for you.

Our Congressmen and Senators have a Winter Recess that usually begins around
the third week in December and ends sometime at the end of January. During
this
time, they are frequently home in their districts, often holding public
meetings, and otherwise somewhat more available to you, their constituents.
This means that if
you call your Congressperson’s local office nearest to your home, this
will give you an opportunity to get to know the staff.
Phoning is now the most powerful way to get your message across, followed
up, if you would like, with e-mail and snail mail. As this campaign to
pass HR 4282 The
Health Freedom Protection Act develops, there will be more reasons for
you to contact your public servant and his or her staff, because it will
take all of us
constantly on the job to make sure our elected public servants know the
people they work for want to have access to REAL information about the
dietary
supplement products they take and want FDA employees given the message
loud and clear.
If you are able to set up an appointment with your public servant while
he or she is home during the Winter Recess, be sure to bring others with
you so that he or she
realizes that you are not alone in your concern about the bill. In all
cases, be sure to state why the bill affects you personally. If you manufacture
or sell these products
be sure to mention that. If you have health issues that have been improved
by using these products and you depend upon them to regain your health
or remain healthy
be sure to mention that as well. Just being for “free speech” on principle
isn’t the same as needing information about the products and using the
products to help you
maintain health. It is critical that your public servant knows this is
a life and death matter to you.
In describing HR 4282 The Health Freedom Protection Act, here are some
of the things this bill will do when it is passed.
(1) amend the drug and health claim provisions of the Food Drug and Cosmetic
Act (FDCA) to permit truthful disease treatment claims for foods and dietary
supplements (presently FDA prohibits all such claims.
(2) prohibit FDA from preventing any who sell foods and supplements from
sending consumers government reports (and accurate quotes form government
reports)
on nutrient-disease associations.
(3) prohibit FDA from preventing any who sell foods and supplements from
sending consumers scientific publications on nutrient-disease associations;
(4) limit FDA disclaimers on health claims to no more than three concise
sentences.
(5) require FDA to permit health claims to be made unless FDA proves there
to be no scientific evidence to support the claims and no disclaimer capable
of avoiding
misleadingness;
(6) compel FDA to approve or disapprove health claim petitions within 100
days or the claims will be automatically allowed.
(7) require FDA to consider studies of the treatment effect of nutrients
in evaluation of nutrient-disease prevention claims.
(8) prohibit FDA from waiving conflicts of interest in its food advisory
panels considering health claims.
(9) reverse FDAs denial or restriction of the following nutrient-disease
association claims: (a) saw palmetto treating benign prostatic hyperplasia;
(b) omega-3 fatty
acids and coronary heart disease; (c) omega-3 fatty acids and sudden death
heart attacks; (d) glucosamine and chondroitin sulfate treating osteoarthritis;
and (e)
calcium reducing the risk of bone fractures.
(10) prevent FDA from disallowing structure function claims that include
terms that refer to signs or symptoms of disease so long as the disease
itself is not
mentioned.
(11) amend the deceptive advertising provisions of the Federal Trade Commission
Act (FTCA) to make all publications exempt from regulation by the amendment
to the FDCA also exempt from regulation by the FTC.
(12) prohibit FTC from regulating as advertising any truthful and accurate
summary of findings from peer-reviewed scientific publication.
(13) require FTC to give notice and an opportunity to cure to any company
suspected of engaging in deceptive advertising of a health benefit.
(14) prohibit FTC from commencing a deceptive advertising investigation
of a health benefit promotion unless FTC possesses proof by a preponderance
of the
evidence that the ad is false and misleading.
(15) require FTC to prove that an ad is false and misleading and that it
actually misleads consumers before FTC may hold an advertiser guilty of
deceptive
advertising.

public support for this bill starting to emerge and if things continue
to go as they are,
passage of this bill may very well change the landscape of health freedom
